Acceptance of Terms
By accessing, browsing, or using the Bali Domains website (balidomains.com), operated by Dewata Tech ("we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Dewata Tech, effective as of February 2026. If you do not agree with any part of these Terms, you must immediately discontinue use of our website and services.
Eligibility
You must be at least eighteen (18) years of age and possess the legal capacity to enter into binding agreements under applicable law to use our services. If you are accessing or using our services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms. We reserve the right to request verification of your identity or authority at any time.
Services
Bali Domains operates as a curated marketplace for premium domain names related to Bali's property and lifestyle markets. Our services include: (a) listing and selling premium domain names from our portfolio, (b) providing an AI-powered chat assistant for domain inquiries, (c) facilitating secure domain transfers through third-party escrow services, and (d) offering bilingual support in English and Indonesian. We act as the direct seller of domains in our portfolio and not as a broker or intermediary for third-party domain owners.
User Responsibilities
When using our services, you agree to: (a) provide accurate, current, and complete information in all communications and transactions, (b) maintain valid and reachable contact details, including a functioning email address and phone number, (c) keep any account credentials and transaction references confidential and secure, (d) promptly notify us of any unauthorized access or security concerns, and (e) comply with all applicable laws and regulations in connection with your use of our services.
Acceptable Use
You agree not to use our website or services to: (a) engage in any fraudulent, deceptive, or misleading activity, (b) violate any applicable local, national, or international law or regulation, (c) scrape, harvest, or collect data from our website using automated tools, bots, or scripts without our written consent, (d) attempt to interfere with, disrupt, or compromise the integrity or security of our website or servers, (e) impersonate any person or entity, or misrepresent your affiliation with any person or entity, (f) transmit malware, viruses, or any other harmful code, or (g) abuse the AI chat assistant for purposes other than legitimate domain inquiries, including generating spam, attempting to extract system prompts, or overwhelming the service with excessive requests.
Domain Purchases
All domain purchases are subject to availability at the time of transaction confirmation. Prices displayed on our website are indicative and denominated in US Dollars (USD), with approximate Indonesian Rupiah (IDR) equivalents provided for reference only. Final pricing may be subject to negotiation and will be confirmed in writing prior to payment. We reserve the right to withdraw any domain from sale, modify listed prices, or decline any offer at our sole discretion. All applicable taxes, transfer fees, and ICANN fees are the responsibility of the buyer unless otherwise agreed in writing.
Payment and Escrow
All transactions are processed exclusively through GoDaddy's escrow service (escrow.com). We do not accept direct bank transfers, cryptocurrency payments, wire transfers, or any payment method outside of the designated escrow process. The escrow service acts as a neutral third party to protect both buyer and seller. Escrow service fees are allocated according to GoDaddy's standard fee schedule unless otherwise negotiated. Payment must be completed within the timeframe specified by the escrow service; failure to complete payment may result in cancellation of the transaction.
Domain Transfer
Upon confirmed payment through the escrow service, we will initiate the domain transfer process within two (2) business days. Domain transfers are typically completed within one to five (1-5) business days, depending on the receiving registrar and domain extension. The buyer is responsible for: (a) maintaining an active account with a reputable domain registrar, (b) providing accurate registrar account details and authorization codes where required, (c) promptly accepting and completing any transfer confirmation steps on their end, and (d) ensuring their registrar account does not have any locks or restrictions that would prevent the transfer. We are not liable for delays caused by the buyer's registrar, incorrect account details provided by the buyer, or domain extension-specific transfer restrictions.
Refund Policy
Cancellation prior to domain transfer: If you wish to cancel a purchase before the domain transfer has been initiated, a refund may be issued subject to any non-refundable escrow service fees already incurred. Post-transfer finality: Once a domain transfer has been successfully completed and the domain is in the buyer's registrar account, the sale is final and no refund will be issued. Technical failure provision: In the unlikely event that a domain transfer fails due to a technical issue on our end and cannot be resolved within fifteen (15) business days, a full refund including escrow fees will be issued to the buyer.
AI Chat Assistant
Our website features an AI-powered chat assistant ("Dewata AI") designed to provide general information about our domain portfolio and assist with inquiries. You acknowledge and agree that: (a) the AI assistant provides informational responses only and does not constitute legal, financial, investment, or professional advice, (b) responses generated by the AI assistant may not always be accurate, complete, or up-to-date, and should be independently verified, (c) the AI assistant is powered by third-party artificial intelligence technology, and your chat interactions may be processed by third-party AI providers (including OpenAI) in accordance with our Privacy Policy, (d) the AI assistant is subject to rate limiting and usage restrictions, and (e) you will not rely solely on AI-generated responses for any purchase decision.
Intellectual Property
All content on the Bali Domains website, including but not limited to text, graphics, logos, icons, images, page layouts, and software, is the property of Dewata Tech or its content suppliers and is protected by Indonesian and international intellectual property laws. The Bali Domains name, logo, and associated branding are trademarks of Dewata Tech. Domain names listed for sale remain the property of Dewata Tech until a transfer has been fully completed. No part of our website may be reproduced, distributed, modified, or republished without our prior written consent.
Domain Name Disputes
The domain names in our portfolio are generic, descriptive names related to geographic locations and property markets in Bali. We believe in good faith that our domain names do not infringe upon the trademarks or intellectual property rights of any third party. Any domain name dispute shall be handled in accordance with the Internet Corporation for Assigned Names and Numbers (ICANN) Uniform Domain-Name Dispute-Resolution Policy (UDRP). Buyers are solely responsible for conducting their own due diligence regarding trademark availability and potential conflicts before completing a purchase.
Warranty Disclaimers
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by Indonesian law, we disclaim all warranties, including but not limited to: (a) implied warranties of merchantability, fitness for a particular purpose, and non-infringement, (b) warranties regarding the accuracy, reliability, or completeness of website content, (c) warranties that our website will be uninterrupted, timely, secure, or error-free, (d) warranties regarding the results that may be obtained from the use of our services, and (e) warranties regarding the accuracy of AI chat assistant responses.
Limitation of Liability
To the maximum extent permitted by applicable law, Dewata Tech, its directors, employees, agents, and affiliates shall not be liable for any: (a) indirect, incidental, special, consequential, or punitive damages, (b) loss of profits, revenue, data, business opportunities, or goodwill, (c) damages arising from unauthorized access to or alteration of your data, (d) damages resulting from third-party service interruptions, including escrow service or AI provider outages, or (e) any other damages arising out of or in connection with your use of our services, regardless of the theory of liability. In any event, our total aggregate liability for all claims arising from or related to these Terms or our services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the fullest extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Dewata Tech, its directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your violation of these Terms, (b) your use or misuse of our services, (c) your violation of any applicable law or third-party rights, (d) any content or information you submit through our website, or (e) any domain name dispute arising after transfer to you. This indemnification obligation survives the termination of these Terms.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: (a) natural disasters, epidemics, or pandemics, (b) acts of war, terrorism, or civil unrest, (c) government actions, sanctions, or embargoes, (d) cyber attacks, DNS infrastructure disruptions, or internet outages, (e) third-party service provider failures (including escrow services, registrars, or AI providers), or (f) power outages or telecommunications failures. We will make reasonable efforts to notify you of any force majeure event and resume performance as soon as practicable.
Dispute Resolution
In the event of any dispute arising from or relating to these Terms or our services, the parties agree to the following resolution process: (a) Negotiation: The parties shall first attempt to resolve the dispute through good-faith negotiation for a period of thirty (30) days from the date written notice of the dispute is given. (b) Mediation: If the dispute cannot be resolved through negotiation, the parties shall submit the dispute to mediation administered by a mutually agreed mediator in Denpasar, Bali, for a period of sixty (60) days. (c) Litigation: If the dispute remains unresolved after mediation, either party may submit the dispute to the courts of Denpasar, Bali, Indonesia, which shall have exclusive jurisdiction.
Governing Law
These Terms of Service are governed by and shall be construed in accordance with the laws of the Republic of Indonesia, including but not limited to Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) as amended by Undang-Undang Nomor 1 Tahun 2024, and its implementing regulations. Any legal proceedings arising from these Terms shall be conducted in the Indonesian language, with English translations provided where necessary.
Modifications to Terms
We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. Modifications will be posted on this page with an updated "Last Updated" date. For material changes that significantly affect your rights or obligations, we will provide prominent notice on our website at least fourteen (14) days before the changes take effect. Your continued use of our website and services after the effective date of any modifications constitutes your acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy and the terms of any applicable escrow service agreement, constitute the entire agreement between you and Dewata Tech regarding the use of our website and services. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter hereof.
